KAHN AUTOMOBILES TERMS AND CONDITIONS OF SALE

These Terms and Conditions of Sale (“Terms”) apply to all contracts for the supply of goods and/or services by Kahn Automobiles, a trading name of Project Kahn Ltd (company number 04960463) and Chelsea Truck Company Ltd. Together referred to as “We”, “Us” or “Our”.

By placing an order with Us, You (“Customer”, “You”, “Your”) agree to be bound by these Terms. Where You are a consumer (purchasing for personal use, not business), additional rights under UK consumer law apply.

1. INTERPRETATION

1.1 Key terms:

Contract – the agreement between You and Us for Goods/Services.

Customer – the person or company purchasing Goods/Services.

Deposit – the percentage of the total price specified in the Order Form, payable on the date stated.

Due Date – the date Goods are available for collection or delivery.

Goods – items described in the Order Form or on our website, including any parts.

Services – fitting, installation, or other services supplied by Us.

Order Form – the form listing the Goods/Services You are purchasing.

VAT – value-added tax or other applicable taxes.

1.2 Headings are for convenience only.
1.3 “Writing” includes email.
1.4 “Person” includes individuals, companies, or legal entities.

2. FORMATION OF CONTRACT

2.1 A Contract is formed only when We send written confirmation, deliver the Goods, or perform the Services. Quotes are not binding.

2.2 Additional or conflicting terms from You are excluded unless confirmed in writing by a director.

2.3 Any advice about storage, use, or compatibility (e.g., tyre sizes) is for guidance only and does not form part of the Contract.

2.4 All catalogues, websites, manuals, drawings, and price lists (“Information”) are for guidance only. We may correct errors without liability.

3. PRICE AND PAYMENT

3.1 Prices are as listed at the time of order and include VAT where applicable. Payment is due before delivery unless credit terms are agreed.

3.2 Prices exclude carriage, insurance, loading/unloading costs, and other applicable taxes or duties.

3.3 Payment is in cleared funds by the Due Date. Late payment may result in interest at 5% above HSBC base rate, suspension of delivery, or retention of deposits.

3.4 You may arrange finance for payment by the Due Date.

3.5 Website pricing errors may result in order cancellation, with the option to purchase at the correct price.

4. CONSUMER RIGHTS – COOLING-OFF AND CANCELLATION

4.1 Your Right to Cancel (Consumers only):

You have 14 calendar days from receipt of Goods to cancel a distance contract (online, email, or phone).

To cancel, notify Us in writing (email, post, or hand delivery) using:

Include Order details, Goods description, and delivery information.

4.2 Exceptions:

Goods made to Your specification or bespoke/custom-built items cannot be returned under the cooling-off period.

Services fully performed with Your consent before the end of the cancellation period may not be cancelled.

4.3 Refunds:

We will refund all sums paid, including standard delivery costs, within 14 days of receiving returned Goods.

You are responsible for return shipping costs.

Refunds will be made using the original payment method unless otherwise agreed.

5. DELIVERY AND RISK

5.1 Delivery dates are estimates. Risk passes on delivery/collection; ownership passes after full payment.

5.2 Instalments are treated as separate contracts. Non-acceptance or delays may incur storage costs, cancellation, or sale of Goods to recover losses.

5.3 You must provide suitable access and labour for delivery. We may refuse delivery if inadequate.

5.4 You should inspect Goods immediately and report shortages/damage within 48 hours.

6. GOODS AND SERVICES SPECIFICATION

6.1 Order Form sets quantity and description.

6.2 We are not responsible for installation unless You purchase Services. Recommendations of installers are without warranty.

6.3 Demonstration products are indicative; delivered Goods may vary slightly.

6.4 Specifications may change for legal, safety, or minor technical reasons.

7. WARRANTIES

7.1 Goods will be of satisfactory quality; Services performed with reasonable care and skill.

7.2 Altered, incorporated, or resold Goods are deemed accepted.

7.3 Where We are not the manufacturer, We transfer any third-party warranty where possible.

7.4 Standard Goods carry a 12-month warranty for manufacturer defects. Vehicles have separate warranty terms.

8. INTELLECTUAL PROPERTY

8.1 You may not use Our Intellectual Property Rights except as expressly authorised.

8.2 Unauthorised copying of Goods makes You liable for losses suffered by Us.

9. LIMITATION OF LIABILITY

9.1 Liability is limited to the price paid for the Goods/Services.

9.2 We exclude liability for indirect or consequential losses, except death or personal injury caused by Our negligence.

10. PERSONAL DATA (GDPR COMPLIANCE)

10.1 We will process Your personal data in accordance with Our Privacy Policy
and applicable UK data protection law.

10.2 Data will be used to:

Deliver Goods and Services;

Process payments;

Inform You of similar products or services.

10.3 You have rights to access, correct, or request deletion of Your data. Contact kahn@kahndesign.com for GDPR requests.

11. FINANCIAL CONDUCT AUTHORITY (FCA) – FINANCE DISCLOSURE

11.1 Project Kahn Ltd (FRN 659619) and Chelsea Truck Company Ltd (FRN 788374) are authorised and regulated by the FCA.

11.2 We are credit brokers, not lenders, and introduce customers to a limited number of lenders at no fee.

11.3 We may receive a commission from the lender, which reflects the work we carry out as a broker. This does not affect the amount you pay and will be disclosed before signing.

11.4 Complaints can be sent to kahn@kahndesign.com, 01274 749999, or 240 Canal Road, Bradford, BD1 4SX. If unresolved, contact the Financial Ombudsman Service. Full complaints procedure available on request.

12. FORCE MAJEURE

We are not liable for delays or non-performance caused by events beyond our reasonable control.

13.2 You may not assign the Contract without Our consent; We may assign or subcontract obligations.

13.3 Third-party rights are excluded unless expressly stated.
